Bodycam footage shows lead-up to Davis Park police shooting during children's sports games

On Nov. 4, deputies shot Dustin Rush, who later died at a hospital. A newly-released video shows the events leading up to the shooting.

NOCATEE, Fla. — Body camera footage has been released in an deputy-involved shooting at Davis Park in Nocatee, which happened on November 4 while hundreds of children were playing soccer. 

The footage released so far does not show the actual shooting, but what led up to the shooting. 

Deputies shot 42-year-old Dustin Rush who was running with a gun through the park with children and families nearby.

At 8:34 a.m. that day, St. Johns County Deputy Taylor Parker made contact with Dustin Rush sitting inside his car under the Palm Valley Bridge. The Sheriff's Office says deputies were searching for Rush and his vehicle after a burglary of a storage facility earlier that morning. 

Holding a taser, Deputy Parker opens the driver's side door, and a struggle with Rush ensued.

"What is going on?" Rush asks. 

"Get out of the car, get out of the car, get out of the car," Deputy Taylor Parker yells to Rush.

"What is going on?" Rush asks again. 

The deputy steps away from the car and tases Rush sitting in the driver's seat. 

"Stop, ouch," Rush says. 

He closes the car door and a few seconds later the deputy breaks the window.

"Hey," Rush shouts to Deputy Parker. 

Rush starts the engine and drives off. Deputy Parker follows his truck towards Ponte Vedra High School and Davis Park. Deputy Parker hits Rush's truck. He loses control and drives into a retention pond.

Rush was armed with a gun. Body camera video shows two deputies saying they fired shots at Rush. It's not known if Rush fired shots at deputies. 

"They take into consideration that if he fires and then runs from them and runs to a group of children or runs onto a baseball field or a soccer field, you have to defend the people in front of you or behind you," First Coast News Crime and Safety Expert Mark Baughman said. 

Rush runs from the vehicle and Deputy Parker follows towards the park's soccer fields when gunshots ring out.

Just feet away, at the Davis Park soccer fields, families call 911 asking for help. 

"There's been a shooting at Davis Park fields A and B," a 911 caller tells dispatchers. 

"All of us that are playing soccer right now are hiding," another person reports. 

"It's an area that's highly congested. It's a sporting area, you have a lot of children, you have a lot of people in the area," Baughman said. 

At 8:38am, the body camera video shows Rush laying on his stomach, not moving near the parking lot of the park. Over the radio, dispatch announces, "10-4 Signal 7, all units 10-4." 

This means 'dead person', but about a minute later, another deputy standing over Rush says he is still breathing. 

"Get me an ATU on standby, he is still breathing," a responding deputy tells dispatchers. 

Deputies in the video can be heard saying Rush was shot in the head and start treating his injuries. First Coast News Crime and Safety Expert Mark Baughman says deputies aren't paramedics. 

"They wait for paramedics to come paramedics are a route, they're going to do what they have to do. But naturally, it's one of those instincts where you want to do what you can do for the individual. But you don't want to do anything that's going to put them more in a grave condition," Baughman said. 

Rush was life flighted to the hospital and later died. No children or adults at the park were hurt that day at Davis Park. The St. Johns County Sheriff's Office Major Crimes Unit is continuing to investigate.
